Macromaat – Terms of Service

Welcome to Macromaat (“Macromaat,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Macromaat mobile application, website, AI features, and all related services (collectively, the “Services”).

By creating an account or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

1. Eligibility

You may use the Services only if:

• You are at least 18 years old,
• You have the legal capacity to enter into a binding agreement, and
• You comply with these Terms and all applicable laws.

Macromaat is not intended for minors, and we may take steps to prevent or remove access if we become aware that a user is under 18.

2. Description of the Services

Macromaat is a nutrition-tracking and meal-planning application that provides:

• Meal logging and calorie/macronutrient tracking
• AI-powered food recognition from photos
• AI chat assistant for nutrition, recipes, and personalized advice
• Recipe discovery and favourites
• Meal planning and grocery list generation
• Fasting timers and related features
• Progress tracking and insights
• Barcode scanning and nutrition lookup

Macromaat is designed for general informational and lifestyle purposes only.

Macromaat does not provide medical advice.

3. No Medical Advice

Macromaat is not a medical service and does not provide medical diagnosis, treatment, or professional healthcare guidance.

You acknowledge and agree that:

• Information provided by the app, including via the AI chat or AI food scanner, is not medical or dietetic advice.
• You should consult a doctor or qualified health professional before making dietary, fitness, fasting, or health decisions.
• You should not use Macromaat if you suffer from a condition that could be affected by changes in diet, fasting, or exercise without supervision from a healthcare professional.
• AI outputs may be inaccurate or incomplete and should not be considered a substitute for professional advice.
• Macromaat is intended only for healthy adults.

4. User Account

To use many features of the Services, you must create an account.

You agree to:

• Provide accurate and truthful information
• Keep your login credentials confidential
• Be responsible for all activities under your account
• Notify us immediately if you suspect unauthorized access

We may refuse registration, suspend, or terminate accounts for violations of these Terms or misuse of the Services.

5. Subscription, Payments & Trials

Macromaat offers both free and paid features. Paid features are accessible through a subscription.

5.1. Billing & Payment Processing

• Payments are processed by Apple (App Store).
• We do not store or process your payment information.
• All billing is governed by the terms of the respective platform.

5.2. Auto-Renewal

Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.

5.3. Cancellation

You must cancel subscriptions through the App Store. Deleting the app or your account does not cancel your subscription.

5.4. Refunds

Refunds are handled exclusively by the App Store, according to their policies.

Macromaat cannot issue refunds directly.

5.5. Price Changes

We may change subscription prices. If required by law, you will be notified in advance and given a chance to cancel before changes take effect.

6. Acceptable Use

You agree not to misuse the Services. This includes, but is not limited to:

• Uploading illegal, harmful, defamatory, or hateful content
• Using the Services for commercial purposes without permission
• Attempting to reverse-engineer, decompile, or copy parts of the Service
• Attempting to access data or systems without authorization
• Uploading viruses, malware, or harmful code
• Harassing or abusing the AI features or support channels
• Using the Services to harm yourself or others

We may suspend or terminate accounts that violate these rules.

7. AI Features (AI Chat & AI Food Scanner)

Macromaat provides AI-driven functionality, including:

• Food recognition from photos
• Calorie and macronutrient estimation
• Recipe suggestions, grocery ideas, and meal planning
• Personalized guidance based on your log history
• Free-form chat responses from the AI assistant

7.1. Limitations

You acknowledge that:

• AI may produce inaccurate, incomplete, or unexpected outputs
• Nutritional estimates from photos are approximations
• AI-generated responses should not be treated as medical or professional advice
• You use AI features at your own risk

7.2. User Responsibility

You must not rely on AI outputs for:

• Medical decisions
• Diagnosing or treating health conditions
• Managing eating disorders or similar health risks

8. User Content

You may upload photos, notes, recipes, and other content (“User Content”).

You retain ownership of your User Content, but by uploading it, you grant Macromaat a non-exclusive, royalty-free, worldwide license to:

• Store your content
• Process it for purposes of providing the Services
• Use it to improve our AI models in anonymized or de-identified form

We do not make your content public.

You confirm that:

• You own the rights to the content you upload
• Your content does not infringe any third-party rights
• Your content complies with these Terms and applicable laws

9. Privacy

Your privacy is extremely important to us. Full details are outlined in our Privacy Policy, which forms part of these Terms.

By using the Services, you consent to Macromaat's collection and processing of personal data as described in the Privacy Policy.

10. Intellectual Property

The Services, including all software, graphics, trademarks, and content, are owned by Macromaat or its licensors.

Users may not:

• Copy, modify, distribute, or create derivative works
• Use Macromaat branding without permission
• Use any automated systems (e.g. bots, scrapers) to access the Services

All rights not expressly granted to you are reserved by Macromaat.

11. Availability & Modifications

Macromaat strives to keep the Services available, but:

• We do not guarantee uninterrupted access
• We may update, modify, or discontinue features at any time
• We are not liable for outages, delays, or data loss caused by third parties, internet issues, or technical failures

12. Termination

We may suspend or terminate your access if:

• You violate these Terms
• You misuse the Service
• You create risk or legal exposure for Macromaat
• We cease operating the Services

You may terminate your account at any time through the app.

Subscription cancellations must still be handled through the App Store.

Upon termination:

• You lose access to the Services
• Your personal data will be handled according to our Privacy Policy

13. Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.”

Macromaat makes no warranties, including:

• That the Services are error-free
• That AI outputs are accurate or appropriate
• That nutrition information is complete or precise
• That the Services will meet your expectations

Macromaat is not liable for:

• Personal decisions you make based on the app's content
• Harm, injury, or medical issues arising from dietary or lifestyle changes
• Errors in logged or AI-estimated nutrition data
• Loss of data due to technical failures outside our reasonable control

14. Limitation of Liability

To the maximum extent permitted by law:

Macromaat shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, data, or goodwill
• Errors or inaccuracies resulting from AI features

Our total liability to you for any claims relating to the Services shall not exceed the amount you paid for the Services in the 12 months preceding the event giving rise to the claim.

If you have not paid for the Services, our liability shall not exceed €50.

15. Governing Law & Disputes

These Terms are governed by the laws of The Netherlands, excluding conflict-of-law rules.

Any disputes shall be resolved exclusively by the competent courts in The Netherlands.

16. Changes to the Terms

We may modify these Terms from time to time.

If changes are material, we will notify you via:

• In-app notification
• Email (if applicable)

Your continued use of the Services after the updated Terms become effective constitutes acceptance of the changes.
